Terms of Use for Selah AI

1. Agreement to Terms
   
   

These Terms of Use (“Terms”) form a legally binding agreement between you and Selah AI (“Selah,” “we,” “us,” or “our”) governing your use of the Selah AI mobile application (the “App”).

By accessing or using Selah AI, including any demo experience, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.

2. Description of the Service
   
   

Selah AI is a faith-based companion application that uses artificial intelligence to provide:

• Spiritual encouragement rooted in Christian faith
  
  

• Relevant Bible scripture and biblical stories
  
  

• Guided prayer
  
  

• Conversational reflection and emotional support
  
  

• Personalized responses using your first name
  
  

Test Conversation During Onboarding

During onboarding, you may try a test conversation with Selah before subscribing. This test conversation:

• Is linked to your account (you’re authenticated)
  
  

• Is stored in your conversation history
  
  

• Counts toward your data and is subject to automatic deletion after 30 days
  
  

• Does not represent unlimited access (subscription required for ongoing use)
  
  

Subscription Required for Full Access

Full, unlimited access to Selah AI requires an active subscription purchased through the Apple App Store.

3. Important Disclaimers
   
   

Not Medical or Mental Health Care

Selah AI is not a licensed therapist, counselor, medical provider, or crisis service. It does not diagnose conditions, prescribe treatment, or provide emergency assistance.

If you are experiencing a mental health crisis or thoughts of self-harm:

Call or text 988 (U.S.)

Call 911 for emergencies

Use local emergency services if outside the U.S.

Do not rely on Selah AI in emergency situations.

AI Limitations

Selah AI uses artificial intelligence, which may produce incomplete, inaccurate, or inappropriate responses. AI cannot understand full human context or replace human judgment, pastoral care, or professional advice.

You are responsible for how you interpret and act on any content provided.

Spiritual Guidance Only

Selah AI provides spiritual encouragement based on Christian faith. It does not represent a church, denomination, or official doctrine and does not replace pastoral leadership or community.

4. Eligibility
   
   

Age Requirement:

• You must be at least 13 years of age to use Selah AI
  
  

• If you are between 13 and 18 years old, you must have parental or guardian consent
  
  

Account Requirements:

To use Selah AI, you MUST:

• Have a valid Apple ID and App Store account
  
  

• Sign in with Apple (mandatory - you cannot skip this)
  
  

• Accept these Terms of Use and our Privacy Policy
  
  

• Grant microphone access for voice features
  
  

• Have an active paid subscription (after onboarding/free trial period)
  
  

Device Requirements:

• iOS device (iPhone only - iPad not supported)
  
  

• iOS 15.0 or later (recommended: latest iOS version)
  
  

• Internet connection (required for AI processing)
  
  

• Sufficient storage for the app (~100 MB)
  
  

5. Subscriptions and Payments
   
   

Plans and Pricing

Selah AI offers the following subscription options:

• Weekly Subscription: $4.99 per week (or equivalent in your local currency)
  
  

• Weekly with Introductory Offer: $0.99 for the first week, then $4.99 per week
  
  

• Annual Subscription: $79.99 per year (save about 70% compared to weekly) (or equivalent in your local currency)
  
  

Specific pricing is displayed in the App during purchase and managed through the Apple App Store. Prices may vary by region and are subject to local taxes.

Billing and Renewal

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
  
  

• Your Apple account will be charged for renewal within 24 hours prior to the end of the current period
  
  

• Billing is handled entirely by Apple through the App Store
  
  

• You can manage your subscription and turn off auto-renewal in App Store Settings
  
  

Introductory Offers

If you are eligible for an introductory offer (e.g., $0.99 for first week):

• The introductory price applies only for the specified period (first week)
  
  

• After the introductory period ends, you will be charged the regular subscription price ($4.99/week)
  
  

• Introductory offers can only be used once per user per subscription type
  
  

• Eligibility is determined by Apple and may vary by region
  
  

• You can cancel before the introductory period ends to avoid being charged the regular price
  
  

Referral Rewards (Free Week)

We offer a referral program where:

• Invite 5 friends via text message to earn 1 week of free premium access
  
  

• Rewards are granted as promotional entitlements through RevenueCat
  
  

• Each user can earn a maximum of 2 free weeks total in their lifetime
  
  

• Invites are tracked using privacy-safe unique identifiers (we don’t know who you invited)
  
  

• Each text message sent counts as 1 invite (iOS doesn’t provide recipient information for privacy)
  
  

• Rewards cannot be transferred, exchanged for cash, or combined with other offers
  
  

• We reserve the right to modify or discontinue the referral program at any time
  
  

Refunds

All refunds are handled by Apple according to App Store policies:

• We do not process refunds directly
  
  

• To request a refund, contact Apple Support or visit reportaproblem.apple.com
  
  

• Refunds are granted at Apple’s sole discretion
  
  

• Subscription time already used is generally not refundable
  
  

6. Device Permissions
   
   

Required Permissions (Cannot Use App Without These):

• Microphone Access: Required to record your voice for AI conversations. Without microphone permission, the voice features will not work.
  
  

• Sign In with Apple: Required for authentication and account creation. You cannot skip this - it is mandatory to use Selah AI.
  
  

Optional Permissions (You Can Decline):

• Notifications: Enables daily reminder at 7:00 PM. Declining does not affect any other features.
  
  

What We Do NOT Access:

The App does NOT request or access:

• Your contacts or address book
  
  

• Your photos, camera, or media library
  
  

• Your location or GPS data
  
  

• Your calendar or reminders
  
  

• Other apps on your device
  
  

• Files or documents
  
  

• Bluetooth devices
  
  

• Health data
  
  

• Background app refresh (beyond normal app behavior)
  
  

All permissions can be managed in iOS Settings → Selah AI.

7. Acceptable Use
   
   

You agree not to misuse Selah AI or use it to:

• Violate laws or regulations
  
  

• Harm, harass, or abuse others
  
  

• Attempt to bypass security or usage limits
  
  

• Automate access or scrape content
  
  

• Resell or share account access
  
  

• Submit illegal, hateful, or harmful content
  
  

We may suspend or terminate access for violations.

8. Usage Limits
   
   

Usage limits may apply to prevent abuse and manage system capacity. Current limits are displayed in the App and may change over time.

9. Intellectual Property
   
   

Selah AI and all related content are owned by Selah AI or its licensors and protected by intellectual property laws.

You are granted a limited, personal, non-commercial license to use the App. You retain ownership of your input but grant us permission to process it solely to provide the service.

AI-generated content is provided for personal use only and may not be redistributed commercially.

10. Disclaimer of Warranties
    
    

Selah AI is provided “as is” and “as available” without warranties of any kind. We do not guarantee accuracy, reliability, availability, or results from using the App.

11. Limitation of Liability
    
    

To the maximum extent permitted by law, Selah AI shall not be liable for indirect, incidental, consequential, or emotional damages, or for decisions made based on AI-generated content.

Our total liability shall not exceed the amount paid by you for the subscription in the 12 months preceding the claim.

12. Dispute Resolution
    
    

These Terms are governed by the laws of the State of Arkansas, United States.

Any dispute shall be resolved by binding arbitration under the rules of the American Arbitration Association, conducted remotely. You waive the right to participate in class actions.

You may opt out of arbitration within 30 days of first use by emailing support@selahai.app.

13. Termination
    
    

You may stop using Selah AI at any time by canceling your subscription through Apple.

We may suspend or terminate access for violations of these Terms or discontinue the service with reasonable notice.

14. Apple App Store Terms
    
    

Your use of Selah AI is also subject to Apple’s App Store Terms and Licensed Application End User License Agreement. Apple is a third-party beneficiary of these Terms.

15. Privacy and Data Protection
    
    

Your use of Selah AI is governed by our Privacy Policy, available at:

• In-App: Accessible through Settings
  
  

Key privacy commitments:

• Conversations automatically deleted after 30 days
  
  

• Developers cannot access your conversations
  
  

• Voice recordings deleted immediately after processing
  
  

• You can delete your account anytime
  
  

16. Account Deletion
    
    

You have the right to delete your account and all associated data at any time.

How to Delete:

1. Open Selah AI → Settings → Support → “Delete My Account”
   
   

2. Or email support@selahai.app with your deletion request
   
   

What Gets Deleted:

• All conversation history
  
  

• Your name and profile information
  
  

• Invite/referral data
  
  

• All personal data associated with your account
  
  

Important Notes:

• Deletion is immediate and permanent (cannot be undone)
  
  

• Account deletion does NOT cancel your App Store subscription - you must do that separately
  
  

• Data already processed by OpenAI follows their retention policy (30-day auto-deletion)
  
  

17. Indemnification
    
    

You agree to defend, indemnify, and hold harmless Selah AI, its officers, directors, employees, contractors, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from:

• Your use or misuse of the App
  
  

• Your violation of these Terms
  
  

• Your violation of any third-party rights
  
  

• Content you submit to the App
  
  

• Any harm or decisions made based on AI-generated content
  
  

• Your failure to comply with applicable laws
  
  

This indemnification obligation will survive termination of your account or these Terms.

18. Modifications to the Service
    
    

We reserve the right to:

• Modify, suspend, or discontinue any feature of the App
  
  

• Change usage limits or restrictions
  
  

• Update AI models or response generation methods
  
  

• Alter the appearance, functionality, or availability of features
  
  

We will provide reasonable notice of material changes when feasible, but we are not obligated to maintain any particular feature indefinitely.

Your continued use after modifications constitutes acceptance of those changes.

19. No Warranty; AS IS Disclaimer
    
    

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

SELAH AI IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY
  
  

• FITNESS FOR A PARTICULAR PURPOSE
  
  

• NON-INFRINGEMENT
  
  

• TITLE
  
  

• ACCURACY OR RELIABILITY OF CONTENT
  
  

• UNINTERRUPTED OR ERROR-FREE OPERATION
  
  

• SECURITY OR FREEDOM FROM VIRUSES
  
  

WE DO NOT WARRANT THAT:

• The App will meet your specific needs or expectations
  
  

• AI-generated responses will be accurate, complete, appropriate, or helpful
  
  

• The service will be available at all times or without interruption
  
  

• Any errors or defects will be corrected
  
  

• Using Selah will result in any particular outcome for your spiritual or emotional wellbeing
  
  

YOU USE SELAH AI AT YOUR OWN RISK.

20. Assumption of Risk
    
    

By using Selah AI, you acknowledge and agree that:

• Artificial intelligence has inherent limitations and cannot replace human judgment
  
  

• AI may produce responses that are incomplete, inaccurate, or contextually inappropriate
  
  

• Spiritual and emotional support requires discernment that AI cannot fully provide
  
  

• You are responsible for how you interpret and act on AI-generated content
  
  

• You will seek professional help (medical, mental health, pastoral) when appropriate
  
  

• You understand that Selah AI is not a substitute for professional care
  
  

• You accept the risks associated with using AI for spiritual guidance and emotional support
  
  

21. Export Control and Compliance
    
    

You represent and warrant that:

• You are not located in a country subject to U.S. Government embargo
  
  

• You are not on any U.S. Government list of prohibited or restricted parties
  
  

• You will comply with all applicable export and import laws
  
  

• You will not export or re-export the App except as permitted by U.S. and local laws
  
  

22. Severability
    
    

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction:

• That provision will be limited or eliminated to the minimum extent necessary
  
  

• The remaining provisions will continue in full force and effect
  
  

• The invalid provision will be reformed to be valid and enforceable while reflecting the original intent
  
  

23. Assignment
    
    

• You may not assign, transfer, or delegate these Terms or your rights hereunder without our prior written consent
  
  

• We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets
  
  

• These Terms bind and inure to the benefit of successors and permitted assigns
  
  

24. Entire Agreement
    
    

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Selah AI regarding your use of the App and supersede all prior or contemporaneous agreements, communications, and proposals (whether oral, written, or electronic) between you and us.

25. Waiver
    
    

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Selah AI.

26. Force Majeure
    
    

We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to:

• Acts of God, natural disasters, or severe weather
  
  

• War, terrorism, riots, or civil unrest
  
  

• Pandemic, epidemic, or public health emergency
  
  

• Government actions, laws, or regulations
  
  

• Labor disputes or strikes
  
  

• Internet, telecommunications, or utility failures
  
  

• Failures of third-party service providers (OpenAI, Firebase, Apple, etc.)

28. Acknowledgment and Acceptance
    
    

By using Selah AI, you acknowledge that:

1. You have read and understood these Terms of Use in their entirety
   
   

2. You agree to be legally bound by these Terms
   
   

3. You understand that Selah AI is not a medical, therapeutic, or crisis service
   
   

4. You will seek professional help when appropriate (medical, mental health, pastoral)
   
   

5. You understand the limitations of AI technology for spiritual and emotional guidance
   
   

6. You are at least 13 years old (or have parental consent if under 18)
   
   

7. You accept full responsibility for how you interpret and act on AI-generated content
   
   

8. You have read and agree to our Privacy Policy
   
   

9. You understand that disputes will be resolved through binding arbitration (Section 12)
   
   

10. You waive the right to participate in class action lawsuits
    
    

11. Emergency and Crisis Disclaimer
    
    

SELAH AI IS NOT AN EMERGENCY SERVICE

If you are in crisis or experiencing a medical or mental health emergency:

• Call 911 immediately for life-threatening emergencies
  
  

• Call or text 988 (Suicide and Crisis Lifeline) - Available 24/7
  
  

• Text HOME to 741741 (Crisis Text Line)
  
  

• Go to your nearest emergency room
  
  

Do not rely on Selah AI for:

• Emergency assistance
  
  

• Crisis intervention
  
  

• Suicide prevention
  
  

• Immediate medical or psychiatric care
  
  

• Life-threatening situations
  
  

Selah AI cannot and does not provide emergency services. Response times vary and AI cannot assess the severity of your situation.

These Terms contain a binding arbitration clause and class action waiver in Section 12. Please read carefully.

By using Selah AI, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy.
